The distressed property space includes both reputable professionals and less scrupulous operators, and the two can sound remarkably similar on a first conversation. Confidence and urgency are characteristics of both genuine services and questionable ones. The difference isn't in the tone. It's in what can actually be checked.
What you should be able to verify, independently
Before you trust any firm with a property matter, you should be able to confirm, without relying on anything they tell you directly:
- That they're a real, registered company. Ask for registration details. A legitimate firm gives them without hesitation.
- That their legal claims are real. If a firm cites a law or a court case, look it up yourself on Kenya Law rather than accepting the citation on faith.
- That the fee structure is stated plainly, in numbers, before you commit to anything. Vague promises ("we'll sort you out") are a warning sign. Specific percentages, stated upfront, are not.
- That you're not being asked for money before anything has been recovered. A firm that needs cash from you first, before doing any work, has an incentive structure worth questioning.
Where 68 AN stands on each of these
We'd rather show you exactly how to check than ask you to simply trust the answer, so here's where to look:
Registration. 68 AN Company Limited is a registered Kenyan company. Ask us directly for the details before engaging us — we'll provide them without pushback. Any firm that hesitates on this specific question is telling you something.
Legal claims. Every statute section referenced on our site — the Land Act 2012, sections 90, 96, 97, 98 and 101 — is publicly available on Kenya Law, free to read. Every principle we rely on has been tested and upheld at appellate level in Kenya. We don't ask you to trust our summary; we'd rather you read the source directly on Kenya Law.
Fees. A success-based commission, tiered by property value: 10% up to KES 600,000, 5% between KES 600,001 and 3,000,000, and 3% above that. Stated in numbers, in advance, not negotiated verbally after you're already committed.
No money upfront. No capital is required from you on either side of the auction. If nothing is recovered, nothing is owed. We're paid only at completion — from the sale proceeds, or from a recovered surplus when it is paid out. Never before.
A direct point worth making plainly
68 AN is a young firm. We don't have a decade of closed cases to point to, and we're not going to pretend otherwise or invent testimonials to paper over it. What we can offer instead is total transparency about the mechanism — the actual statute, the actual case law, the actual fee, all checkable by you, independently, before you commit to anything.
A firm that shows you exactly how to verify it is, structurally, a different kind of firm from one that just asks you to trust it. That's the whole basis of this answer.
